Definition

Postal service activities that are carried out in the form of providing universal basic postal services, which consist of the use of infrastructure for providing universal basic postal services, such as post offices, sorting and operation centers and transportation lines for receiving and delivering postal items. The types of items delivered include postal items, such as letters, postcards, printed matter (newspapers, journals, advertisements, etc.), small parcels, goods or documents, and including other services necessary to support the provision of universal basic postal services, including the receiving, sorting, transporting and delivering postal items, postal parcels and packages both domestically and internationally by the post office, which is obligated to provide universal basic postal services. The collection of postal items and postal parcels from post offices or from post offices, as well as the forwarding and delivery of postal items and postal parcels, may use one or more modes of transport and may be carried out using its own (private) transportation network or public transport services.

Foreign ownership

Not on the Foreign Business Act restricted lists.

The Foreign Business Act B.E. 2542 (1999) restricts majority foreign ownership only for the activities named in its three annexed Lists. This activity is not among the mappings we hold, so a foreign investor can generally hold up to 100% of the equity, subject to any sector-specific licence and to minimum-capital rules (typically THB 2 million per restricted business, or THB 3 million where a Foreign Business Licence applies).

If an activity is restricted, the routes to foreign majority

  • BOI promotion — the Board of Investment can grant up to 100% foreign ownership for promoted activities, with tax and non-tax incentives.
  • Foreign Business Licence — permission from the Ministry of Commerce to operate a List 2 or List 3 activity as a foreign-majority company.
  • US Treaty of Amity — US nationals may hold majority ownership in most activities, treated as Thai nationals for FBA purposes.
