Definition

Activities of providing services related to drilling for oil and natural gas that are performed for compensation or under a contract, including the following activities: Exploration services related to drilling for crude oil or natural gas, using traditional methods such as geological surveys of areas where oil or natural gas sources are expected to exist, drilling inclined wells and re-drilling oil wells, installing drilling rigs, repairing and dismantling drilling rigs, cementing casings for crude oil and natural gas wells, pumping oil from production wells, cementing wells where petroleum is not found for the purpose of abandoning the well, changing the state of natural gas from liquid to natural gas and changing it back to natural gas for transportation, which is performed at petroleum production sites, draining and pumping oil that is performed for compensation or under a contract, testing drilling related to crude oil or natural gas, including providing fire-fighting services and fighting fires in areas of crude oil and natural gas sources.

Excluded from this code

  • Service activities performed by employees working regularly at crude oil or natural gas wells, see subgroups 0610 and 0620.
  • Repair of mining machinery requiring specialized personnel, see subgroup 3312.
  • Conversion of natural gas to liquids and regasification for transport, carried out outside mining, see subclass 5221.
  • Geophysical surveys, geological surveys and seismic surveys, see subgroup 7110.

Foreign ownership

Not on the Foreign Business Act restricted lists.

The Foreign Business Act B.E. 2542 (1999) restricts majority foreign ownership only for the activities named in its three annexed Lists. This activity is not among the mappings we hold, so a foreign investor can generally hold up to 100% of the equity, subject to any sector-specific licence and to minimum-capital rules (typically THB 2 million per restricted business, or THB 3 million where a Foreign Business Licence applies).

If an activity is restricted, the routes to foreign majority

  • BOI promotion — the Board of Investment can grant up to 100% foreign ownership for promoted activities, with tax and non-tax incentives.
  • Foreign Business Licence — permission from the Ministry of Commerce to operate a List 2 or List 3 activity as a foreign-majority company.
  • US Treaty of Amity — US nationals may hold majority ownership in most activities, treated as Thai nationals for FBA purposes.
